These Terms & Conditions (“Terms”) govern your access to and use of chesspe.com and the ChessPe applications and services (together, “ChessPe” or the “Platform”), operated by CHESSPE SPORTS TECHNOLOGIES PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 (CIN U62011UP2026PTC252990), with its registered office at Arazi No 820/1, Sector A 187, Vsi Shivpur, Varanasi – 221003, Uttar Pradesh, India (“ChessPe”, “we”, “us”, “our”). By accessing the Platform, creating an account, registering for a tournament or making a payment, you agree to be bound by these Terms, our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, do not use the Platform.

This document is an electronic record under the Information Technology Act, 2000 and the rules made under it, and does not require a physical or digital signature.

1. Definitions

• Organiser — a club, academy, school, association, company or individual that lists and conducts a Tournament through the Platform.
• Player — a person who registers for a Tournament, including a parent or guardian registering a minor.
• Tournament — an over-the-board chess event listed on the Platform by an Organiser.
• User — anyone who accesses the Platform, including Players and Organisers.

2. Nature of the Platform — ChessPe is an intermediary

ChessPe is a technology platform that enables Organisers to list Tournaments and Players to discover, register for and pay for them. ChessPe does not organise, conduct, supervise, own or control any Tournament, is not a party to the arrangement between an Organiser and a Player, and does not act as an agent of either except for the limited purpose of collecting entry fees on the Organiser’s behalf (section 6). ChessPe is an “intermediary” within the meaning of the Information Technology Act, 2000 and, to the extent applicable, an e-commerce marketplace entity under the Consumer Protection (E-Commerce) Rules, 2020.

All information about a Tournament — including its date, venue, schedule, format, entry fee, prizes, eligibility, rules, arbiters and refund terms — is provided by its Organiser, who is solely responsible for its accuracy and for holding the Tournament as described.

ChessPe is not a gaming, betting, wagering or fantasy-sports platform. Tournaments are games of skill played in person, entry fees are payments for participation in a sporting event, and no part of the Platform involves wagering on any outcome.

3. Eligibility and accounts

• You must be at least 18 years old and able to form a binding contract under the Indian Contract Act, 1872 to create an account in your own name.
• A person under 18 may use the Platform and take part in Tournaments only through a parent or legal guardian, who registers on their behalf, gives verifiable consent to the processing of the minor’s personal data, accepts these Terms for the minor and is responsible for the minor’s use.
• You must provide true, accurate and complete information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account.
• You may not create an account for anyone else without authority, or hold more than one account.

4. Organisers

By listing a Tournament, an Organiser represents, warrants and agrees that it:

• has completed ChessPe’s verification (including KYC and bank-account verification) and that all information provided is true;
• is solely responsible for conducting the Tournament, including the venue, safety and conduct of participants and spectators, first aid, equipment, arbiters, pairings, results, prizes, certificates, and all permissions, licences and approvals required by law or by any chess federation or association;
• is solely responsible for awarding prizes as advertised, and for any tax obligations on the Tournament, its revenue and its prizes, including deduction of tax at source on prize money where the law requires it;
• will publish clear refund terms before accepting registrations, honour them, and refund every Player in full if it cancels the Tournament;
• will comply with all applicable laws, including laws on consumer protection, taxation, child safety and data protection, and will use Player data only to conduct the Tournament; and
• will indemnify ChessPe as set out in section 13.

ChessPe may review, reject, suspend or remove any Tournament listing, withhold or reverse settlements where there is a dispute, chargeback, suspected fraud or cancellation, and suspend any Organiser that breaches these Terms.

5. Players

• Before registering, you must read the Tournament’s details, rules, eligibility and refund terms. Registering means you accept them.
• You are responsible for meeting the Tournament’s eligibility conditions (for example age, rating or school); a registration obtained with false information may be cancelled without refund.
• You take part in a Tournament at your own risk and must follow the Organiser’s rules, the arbiters’ instructions and the venue’s rules. The arbiters’ decisions on play are final under the Tournament’s rules.
• A parent or guardian registering a minor is responsible for the minor’s supervision, travel and conduct at the Tournament.

6. Fees and payments

• All prices are in Indian Rupees. Before you pay, the checkout shows the entry fee (and any registration fee) set by the Organiser, the ChessPe platform fee, and any convenience fee charged by the payment gateway for the payment method you choose.
• Payments are processed by RBI-authorised payment aggregators and banks. ChessPe does not see or store your card number, CVV, UPI PIN or net-banking password. Your payment is also subject to the terms of the payment provider and your bank.
• ChessPe collects the entry fee on behalf of the Organiser, retains the platform fee as consideration for use of the Platform, and settles the entry fee to the Organiser. The entry fee is the Organiser’s revenue; the platform fee is ChessPe’s.
• A registration is confirmed only when the payment succeeds and a confirmation is issued. ChessPe is not responsible for a payment that fails, is delayed or is declined by your bank or payment provider; any amount debited for a failed transaction is reversed by the provider under its own timelines.
• Fees may attract taxes as required by law.

7. Refunds and cancellations

Refunds are governed by our Refund & Cancellation Policy. The refund terms of a Tournament are set by its Organiser, and the Organiser is responsible for refunds it owes; ChessPe processes refunds through the payment provider on the Organiser’s instructions or as the Policy states.

8. Acceptable use

You must not use the Platform to:

• host, display, upload, share or publish anything that is unlawful, defamatory, obscene, harmful to children, infringes anyone’s intellectual property or privacy, impersonates any person, is misleading, or is prohibited under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
• list a fake Tournament, make false registrations, or collect money for an event that will not be held as described;
• access another person’s account or data, probe, scrape or disrupt the Platform, introduce malware, or bypass any security or access control; or
• use the Platform for gambling, wagering, money laundering or any other unlawful purpose.

We may remove content and suspend or terminate accounts that breach this section, and may report unlawful activity to the authorities.

9. Content, results and data

You keep ownership of content you upload (for example games, photos and profile details) and grant ChessPe a non-exclusive, royalty-free, worldwide licence to host, display and use it to operate and promote the Platform. Tournament results, standings, pairings and ratings are published as supplied by Organisers and arbiters; ChessPe does not guarantee their accuracy and is not the authority for any rating or title. Analysis, statistics and coaching suggestions on the Platform (including those generated by computer engines or AI) are for information only.

10. Intellectual property

The Platform, its software, design, text, graphics and the “ChessPe” name and logo belong to ChessPe or its licensors. You may not copy, modify, distribute or reverse-engineer them except as the law expressly permits.

11. Third-party services

The Platform relies on third-party services such as payment gateways, banks, cloud hosting, email and messaging providers, and links to third-party websites. ChessPe is not responsible for their availability, acts or omissions, or content.

12. Disclaimer of warranties

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, ChessPe makes no warranty that the Platform will be uninterrupted, error-free or secure, and makes no warranty or representation about any Tournament, Organiser, Player, venue, prize or result. ChessPe does not endorse any Organiser or Tournament by listing it.

13. Indemnity

You agree to indemnify and hold harmless ChessPe, its directors, employees and agents from any claim, demand, loss, liability, penalty or expense (including reasonable legal fees) arising from your breach of these Terms or of any law, your content, or — for Organisers — the conduct, cancellation or any incident at or relating to a Tournament you list, including claims by Players, spectators, venues or authorities and claims relating to prizes or taxes.

14. Limitation of liability

To the maximum extent permitted by law: (a) ChessPe is not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, data, opportunity or goodwill; (b) ChessPe is not liable for any personal injury, loss of or damage to property, travel or accommodation cost, or other loss arising from attending or taking part in a Tournament, or from the acts or omissions of any Organiser, Player, arbiter, venue or other User; and (c) ChessPe’s total aggregate liability for any claim relating to the Platform is limited to the platform fee ChessPe received for the registration concerned, or, where no registration is concerned, ₹1,000. Nothing in these Terms excludes liability that cannot be excluded under Indian law, including rights of consumers under the Consumer Protection Act, 2019.

15. Force majeure

ChessPe is not liable for any failure or delay caused by events beyond its reasonable control, including natural disasters, epidemics, government orders, war, riots, strikes, failure of power, internet, telecom, banking or payment systems, or cyber-attacks.

16. Suspension and termination

You may stop using the Platform and ask us to delete your account at any time. ChessPe may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law or a lawful order, or to protect other Users or the Platform. Sections that by their nature should survive termination (including 9, 12, 13, 14 and 18) survive it.

17. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the current version. Material changes will be notified on the Platform before they take effect, and continued use after that means you accept them.

18. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Platform shall first be raised with our Grievance Officer (section 19). If it is not resolved within 30 days, it shall be referred to arbitration by a sole arbitrator appointed by ChessPe under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Varanasi, Uttar Pradesh, and the language English. Subject to this, the courts at Varanasi, Uttar Pradesh have exclusive jurisdiction. This section does not prevent a consumer from approaching a consumer commission where the law allows.

19. Grievance Officer

In accordance with the Information Technology Act, 2000, the rules made under it and the Consumer Protection (E-Commerce) Rules, 2020, the Grievance Officer is:

Complaints are acknowledged within 48 hours and resolved within one month of receipt, or within any shorter period the law requires.

20. General

These Terms, together with the Privacy Policy and the Refund & Cancellation Policy, are the entire agreement between you and ChessPe about the Platform. If any provision is held invalid, the rest remains in force. A failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms; ChessPe may assign them to an affiliate or successor. Notices to ChessPe must be sent to support@chesspe.com.
